Why is a working product key not enough?
A Microsoft product key is a technical component of activation. A software licence is the permission to use a product under defined terms. Those concepts are related, but they are not identical. A legitimate purchase needs an appropriate entitlement, not simply a string of characters that an activation service accepts.
Problematic offers can involve stolen payment details, leaked commercial keys, restricted educational or developer entitlements, or keys already supplied to other buyers. Some may fail immediately; others may activate before a later problem becomes apparent. Conversely, a legitimate key can encounter an ordinary installation or activation error.
That is why a sensible buyer uses several kinds of evidence: seller identity, product accuracy, licence documentation, safe fulfilment, activation status and meaningful customer support. No single screenshot or online key checker can replace the whole assessment.
What does EU law actually say about software resale?
The central judgment is the Court of Justice of the European Union's decision of 3 July 2012 in UsedSoft GmbH v Oracle International Corp., C-128/11. It explains how exhaustion of the distribution right can apply to software supplied by download together with a licence granting use for an unlimited period, where the copyright holder receives a fee intended to reflect the economic value of the copy.
The conditions matter. The relevant first sale must fall within the EU exhaustion framework and be made by the right holder or with its consent. On resale, the original acquirer must make its own copy unusable. A seller cannot rely on exhaustion while the original buyer continues using the transferred entitlement.
The judgment also rejects using exhaustion to split a licence covering more users than the original buyer needs and resell only the spare portion. That does not mean every commercial licence arrangement is identical; it means that the exact entitlement and transfer history must be examined. A bare key does not establish compliance.
UsedSoft is not a general permission to resell any Microsoft account, temporary subscription, cloud service or restricted entitlement. Nor does the word perpetual resolve every contractual, territorial or evidential issue. For a high-value organisational purchase, obtain specialist legal or software-licensing advice rather than treating a seller's reference to the case as a complete legal opinion.
What evidence should a credible seller provide?
An accountable seller should make it possible to identify the contracting business, understand what is being sold and contact someone if the product does not match the description. An invoice should identify the product and quantity, but an invoice by itself cannot cure an invalid entitlement.
For resale stock, ask for documentation appropriate to the licensing channel and your intended use. Relevant evidence may include the original entitlement, the chain of transfers and confirmation that the previous holder has stopped using the transferred licence. There is no universal public Microsoft database that turns every resale key into a complete, independently verified ownership record.
Business buyers may reasonably need more detail than an individual buying a single household licence. Put those requirements in writing before payment. A seller should be able to explain what evidence it supplies without asking you to treat successful activation as the only proof.
- · A legal business name, business address and usable contact route.
- · A precise product name, edition, platform and device or user quantity.
- · Disclosure of the licensing channel and any relevant restrictions.
- · An invoice and appropriate entitlement or transfer documentation.
- · Clear installation instructions using legitimate Microsoft sources.
- · Written refund terms and a process for handling invalid or mismatched products.
Which warning signs deserve the most attention?
Do not treat every appearance of MAK or KMS as proof of fraud. Multiple Activation Keys and Key Management Service are legitimate Microsoft mechanisms in the right commercial environment. The red flag is an activation arrangement that has no credible connection to your lawful entitlement.
Similarly, telephone activation can be a legitimate Microsoft process where available. The problem is pressure to misrepresent ownership, use an unofficial service or accept a mysterious workaround instead of resolving the actual licensing issue.
| Warning sign | Why it matters | What to do |
|---|---|---|
| A perpetual or lifetime Microsoft 365 subscription claim | Microsoft 365 is subscription-based, so an unlimited one-time promise is not a standard consumer entitlement | Request the exact official plan and contractual duration; reject unsupported promises |
| A shared account instead of an entitlement for you | The seller may retain control, and the arrangement may not grant the promised usage rights | Do not rely on shared credentials as proof of ownership |
| An unexplained external KMS server | KMS is intended for authorised organisational activation, not anonymous consumer workarounds | Ask for the licensing basis; do not connect to an untrusted activation service |
| Instructions to disable security tools | The installer or activator may be unsafe or designed to bypass licensing | Stop and use official Microsoft installation sources |
| Only a key is supplied, with no product or licence information | You cannot establish what rights were sold | Request an invoice and written entitlement details |
| An unusually low price and anonymous seller | Price is inconclusive, but poor accountability increases the risk | Verify the business and terms before paying |
How can you check activation safely after purchase?
Install from a legitimate Microsoft source appropriate to the product and licensing channel. Match the edition before entering the key: a Windows Home installation, for example, is not the same product as Windows Pro. With Office, distinguish retail products from commercial LTSC packages and follow the correct deployment instructions.
For Windows 11, open Settings, then System, then Activation. Confirm the installed edition and activation state. Microsoft's built-in commands slmgr /dli, slmgr /dlv and slmgr /xpr can display additional licence or activation information. They are diagnostic checks, not tools that certify the legal provenance of a purchase.
For Office on Windows, the Account area of an application normally shows product and activation information. On Mac, use the application's account and licence information for the relevant edition. A Microsoft account purchase or services record can be relevant for products redeemed there, but not every valid commercial licence appears as a consumer account purchase.
Save the purchase evidence
Keep the invoice, order confirmation, original listing and applicable refund terms.
Install the matching official product
Use the correct platform, edition and licensing channel from a legitimate Microsoft source.
Check the built-in activation status
Confirm the product name and activation state, and record any exact error code.
Resolve discrepancies with the seller
Ask for an explanation if the supplied edition, activation method or licence scope differs from the listing.
Protect sensitive information
Do not publish the full key, account credentials or unredacted diagnostic screenshots, and do not submit keys to unknown checking websites.
What should you do if activation fails or the offer changes?
Start with ordinary causes: a typing mistake, an edition mismatch, an internet problem or a previous installation using the wrong activation channel. Record the exact error rather than repeatedly trying unrelated installers. Activation failure is a reason to investigate, not immediate proof of counterfeiting.
Contact the seller through its documented support route with the order number, installed edition and error code. Microsoft support may help diagnose an activation problem, but technical diagnosis does not replace the seller's responsibility to explain what was sold. If the seller suddenly supplies a different edition or demands an activation bypass, stop.
Where the product is invalid, materially different from the description or unsupported by promised documentation, request the appropriate remedy. Retain correspondence and use your payment provider's dispute process if necessary, observing its deadlines. If you ran an unknown activator, treat that as a separate security incident and use trusted security guidance before continuing.
How much protection does a 14-day refund policy provide?
LicenseVault offers a 14-day refund policy. Read its written conditions before ordering, including how to submit a request and how the policy treats redeemed or activated keys. A voluntary policy can provide useful reassurance, but its scope should not be guessed from a short badge or headline.
The policy is separate from statutory consumer rights. EU rules generally provide a withdrawal period for distance contracts, but digital content not supplied on a tangible medium has a specific exception when performance begins with the consumer's prior express consent and acknowledgement of losing the withdrawal right, subject to the applicable requirements.
That withdrawal exception does not automatically remove remedies when supplied digital content fails to conform to the contract. Applicable national law and the circumstances of the sale matter, and business purchases do not necessarily receive the same consumer protections. If a dispute is significant, consult a consumer adviser or qualified legal professional.
What is the safest final buying checklist?
The strongest purchase is one where every element tells the same story. The listing names a specific edition, the invoice records the same product, the licence evidence supports the intended use, the installation comes from a legitimate source and the activation method fits the documented channel. Inconsistencies deserve answers before you rely on the software.
LicenseVault is an EU reseller of genuine Microsoft licence keys, delivered by email with a 14-day refund policy. Assess any purchase against the exact product page and supplied terms rather than assuming that email delivery, a low price or a working key proves all licensing questions. Check the product page for the current price.
For business-critical software, prioritise traceable entitlement and a supportable deployment over the cheapest activation. A clear answer to who may use what, on which device, under which licence is more valuable than a promise that a key will work today.
- · I can identify the seller and contact it through a documented route.
- · I know the exact edition, platform, quantity and licensing channel.
- · I have adequate evidence of entitlement for my intended use.
- · I will install through a legitimate Microsoft source without bypass tools.
- · I understand both the seller's refund policy and any applicable statutory rights.
- · I will retain the invoice, licence records and activation evidence securely.
Frequently asked questions
- Does a very low price prove that a Microsoft key is fake?
- No. Price alone proves neither legitimacy nor fraud, and genuine resale pricing can differ from new retail pricing. An unusually low price should prompt closer checks of the seller, product channel and licence documentation rather than an automatic conclusion.
- If Windows says it is activated, is my licence definitely genuine?
- No. Activation confirms a technical licensing state, not the complete lawful origin and transfer of the entitlement. Misused volume keys or other unauthorised keys can sometimes activate. Keep the invoice and appropriate licence evidence as well as checking activation.
- Are second-hand software licences legal in the EU?
- Qualifying resale can be lawful under EU exhaustion principles, including those explained in UsedSoft v Oracle. Conditions concerning the original transaction, duration of rights, first acquirer's use and transfer must be satisfied. The judgment does not legalise every advertised key or every subscription resale.
- Is a volume-licence key automatically a scam?
- No. Volume licensing is a legitimate Microsoft licensing channel. The question is whether you have a properly documented entitlement and an authorised activation arrangement. Access to a shared key or an unexplained corporate activation server is not enough.
- Does every emailed key come with an unconditional legal 14-day return right?
- No. EU withdrawal rules for digital content include an exception where supply begins with the consumer's prior express consent and acknowledgement that the withdrawal right is lost, subject to the applicable requirements. A seller's voluntary refund policy and remedies for non-conforming content are separate matters.
